Lawsonline is a firm of solicitors (David Laws Solicitors) that operates as a separate arm of that business and it is different – very different – and our clients love it!

It is the brainchild of David Laws, a solicitor with decades of experience including roles in running his own solicitor’s practices as well as having been a partner for 12 years, heading up a commercial litigation department in a large firm of solicitors. Over time this has involved covering a very varied and extensive range of legal issues.

With so much experience in the law, it became obvious to David that so many businesses and individuals were all too often avoiding obtaining the legal advice and help they needed because of a fear of the level of the costs involved and the time taken. What’s more, the Law Society have been actively encouraging solicitor’s practices where possible to be prepared to offer what’s known as ‘unbundled’ legal services to their clients as a cost saving exercise.

So it was that David set about designing a new means of providing legal advice and help and worked with experienced web designers to achieve the unique service that we offer today. This is headed up by David Laws, assisted by specialist solicitor consultants and on the administration side of things by Jackie Collinson.

We offer individually tailored specialist legal advice and assistance on the issue concerned and/or a combination of that advice with the drafting of court documents or legal correspondence as required. All matters are dealt with by experienced qualified solicitors.

Case studies:

The nature of the enquiries we have received and dealt with has been incredibly diverse but here are a few instances where we have assisted clients to achieve very successful outcomes to their legal issues whilst making significant costs savings as part of the process:

Dealing with an unknown CCJ:

A limited company had a county court judgement filed against it but its director had previously been totally unaware that the court proceedings had been issued against the company.

We advised the director concerned as to various practicalities and as to the steps to be taken (and court form to be used) in making a successful application to the court to set the judgment aside.

Failure to provide services:

A limited company had approached the Communications Ombudsman Service concerning extensive failings on the part of a provider of business communications systems.

We advised as to the contents of the content and potential use of the Ombudsman’s reports (provisional and final) in terms of exerting pressure on the provider who was pursuing claims against the client. Following receipt of a further enquiry, we further advised as to additional legal aspects that had arisen and drafted a formal letter before action that (among other things) embraced the Ombudsman’s findings.

This eventually led to a successful agreed resolution.

Reinstatement of wrongly forfeited shares:

Our client had a significant shareholding in a limited company. The company claimed that he owed money to the company and that it was entitled to make a formal ‘call’ on his shares, followed by a forfeiture of them. We advised that this was illegal in the circumstances and assisted him as a “litigant in person” to total success through the High Court in achieving an order that his shares be re-instated.

Help with Court Documentation:

We received an enquiry from someone who was acting as a “litigant in person” in defending court proceedings. The court had ordered the parties to provide standard disclosure of documents by list and category.

This is normally a very expensive stage in proceedings because of the amount of time a solicitor would need to be involved. However, we advised the client precisely on (i) the completion of the standard disclosure court form N265; (ii) the legal requirements of ‘standard disclosure’ and how to deal with those; and (iii) how to collate and schedule the relevant documents for that.

That party went on to win their case and obtained a costs order in their favour in respect of the costs incurred with us. It represented a very significant costs saving to them on their journey through the court process, with the additional costs recovery being the icing on that particular legal cake.

Employee Breach of contract:

A client who owned a cleaning services business requested our advice and assistance concerning matters on which there had been breaches of contract by 3 former employees. These included breaches of non-competition clauses and claims for resulting compensation.

We advised and assisted successfully and all 3 were held accountable and compensation was recovered. We also advised successfully concerning enforcement.

Counterclaiming for overcharges:

A ‘trendy’ firm of London accountants had grossly overcharged our client in respect of her business and issued proceedings against her in respect of their claim.

We drafted an appropriate Defence and Counterclaim for her and also assisted with drafting relevant correspondence, all of which eventually resulted in the claim against her being completely withdrawn.
